1. Acceptance of terms

By accessing or using Third Honk (the Platform), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Platform. Third Honk LLC reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

2. Description of service

Third Honk is an online community platform for automotive enthusiasts based in Texas and beyond. The Platform allows registered users to create accounts, post content including text, images, videos, and links, and interact with other users through likes and comments.

3. User accounts

To access full features of the Platform, you must create an account using Google or Facebook authentication. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account at thirdhonk@gmail.com.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice.

4. User content

You retain ownership of content you post to the Platform. By posting content, you grant Third Honk LLC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.

You are solely responsible for your content. You represent and warrant that your content does not violate any third-party rights or applicable laws.

We do not pre-screen content but reserve the right to remove any content that violates these Terms or that we determine to be harmful, offensive, or otherwise objectionable.

5. Prohibited conduct

You agree not to use the Platform to:

• Post content that is illegal, harassing, defamatory, obscene, or threatening
• Impersonate any person or entity
• Post spam, unsolicited advertising, or promotional material
• Upload content containing viruses or malicious code
• Collect or harvest personal data about other users without consent
• Interfere with or disrupt the Platform or its servers
• Violate any applicable local, state, national, or international law

6. Content moderation

The Platform allows users to flag content for review. Flagged content is reviewed by our administrators, who may remove content or suspend accounts at their discretion. We are not obligated to monitor all content but will respond to reports in good faith. Third Honk LLC is not liable for any user content posted on the Platform.

7. Intellectual property

The Third Honk name, logo, and all Platform content created by us are owned by Third Honk LLC and protected by applicable intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

8. Section 230 notice

Third Honk LLC is an interactive computer service provider under Section 230 of the Communications Decency Act. We are not the publisher or speaker of content posted by third parties and are not liable for such content. Users are solely responsible for the content they post.

9. Disclaimers

THE PLATFORM IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND. THIRDHONK LLC DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THIRDHONK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Governing law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Travis County, Texas.
